The online shop www.madshop.ch is operated by Mad Beauty Shop GmbH. These General Terms and Conditions (GTC) apply to all services and deliveries provided or offered through www.madshop.ch.

The offer is intended for customers residing in Switzerland, the Principality of Liechtenstein, and all European countries to which delivery is possible.

By submitting an order, the customer accepts these GTC. Changes to the GTC may occur at any time and become effective upon publication on www.madshop.ch.

Mad Beauty Shop GmbH reserves the right to reject orders without providing any reason.

2.2

If the goods ordered by the customer are not available in the desired quantity or at the price indicated on the website, Mad Beauty Shop GmbH will inform the customer accordingly. In such a case, the contract is only concluded when the customer explicitly confirms the amended conditions by email or in another written form.

2.3

By placing an order through the in-store application, the customer submits a binding offer. Mad Beauty Shop GmbH accepts this offer by sending a delivery note to the customer. With this acceptance, the contract is considered concluded.

2.4

At the time of order completion, the statutory value-added tax (VAT) is shown and charged separately in the shopping cart.

3.1

The current prices are published on the website at www.madshop.ch.

3.2

The prices valid at the time of the order are binding for both parties. However, in the case of obvious mistakes or errors in pricing, www.madshop.ch reserves the right to make price adjustments even after the fact. In such a case, the customer will be informed immediately and is not obligated to purchase the affected products.

3.3

In addition to the listed product prices, shipping costs apply depending on the chosen delivery method. These costs are shown on the respective product page.

3.4

For orders with a total value of CHF 100 or more (after discounts and special offers), www.madshop.ch covers the shipping costs. This does not apply to additional charges for special shipping methods such as A-Post Signature.

4.1

Registration on www.madshop.ch is reserved exclusively for fully legally competent natural persons. By placing an order, the customer confirms that they are at least 18 years old, capable of judgment, and not under guardianship.

There is no entitlement to access the online shop. The information required for registration must be provided by the customer completely and truthfully. The customer is solely responsible for keeping their information up to date at all times.

5.1

An order becomes binding for the customer as soon as they click the “Place Order” button at the end of the order process on the order summary page. By clicking this button, the customer submits a binding offer to conclude a purchase contract.

5.2

If the ordered goods are not available, the customer will be informed immediately. An individual solution will then be arranged with the customer (e.g., replacement delivery, refund, or delayed delivery).

6.1

The customer is responsible for providing a complete and accurate delivery address. If the address provided is incorrect or incomplete, delivery may not be possible. In such cases, www.madshop.ch is entitled to withhold delivery without any entitlement to compensation or damages.

6.2

All stated delivery times are non-binding and should be considered as approximate guidelines. No guarantee is provided for adherence to these timeframes.

6.3

Mad Beauty Shop GmbH assumes no liability for delivery delays beyond its control — such as those caused by force majeure, traffic disruptions, weather conditions, or public holidays. Such delays do not entitle the customer to withdraw from the purchase contract or to claim damages.

7.1

The risk of loss, damage, or destruction of the goods transfers to the customer upon handover of the goods to the shipping provider. This applies regardless of who bears the shipping costs.

8.1

The following payment methods are accepted by www.madshop.ch:

• Credit Card (Visa, Mastercard, etc.)
• TWINT
• PayPal
• Prepayment: After placing the order, the customer receives an invoice by email. The goods will only be shipped once the full invoice amount has been received by Mad Beauty Shop GmbH.

9.1

The delivered goods remain the property of Mad Beauty Shop GmbH until the full purchase price has been paid. Prior to the transfer of ownership, pledging, transfer by way of security, processing, or modification of the goods is not permitted without the express consent of Mad Beauty Shop GmbH.

10.1

For all products purchased from www.madshop.ch, we offer a return right within 14 days of receiving the goods. The return date (postmark) is decisive for meeting the deadline. Returns are only accepted if the products are in perfect condition — meaning undamaged, unused, unopened, and in their original packaging.

10.2

Products that are unsuitable for return for health or hygiene reasons (e.g., opened cosmetic products) are excluded from the right of return.

10.3

We cover the return shipping costs if you request a free return label in advance. This can be requested via email at info@madshop.ch or by phone at 044 311 25 25.

10.4

The customer is obliged to inspect the delivered goods immediately upon receipt.

10.5

Complaints regarding quality, completeness, or other defects must be reported to Mad Beauty Shop GmbH immediately, and no later than 5 working days after delivery.

10.6

If no timely notice of defects is made, the goods are considered accepted and free of defects.

10.7

Returns or exchanges due to dislike or incorrect ordering are excluded.

10.8

Order cancellations are only possible following individual agreement with Mad Beauty Shop GmbH.

11.1

Ordered products are generally delivered via Swiss Post. Depending on the destination country or specific circumstances, another shipping service provider may also be used.

12.1

The customer acknowledges and accepts that the delivered products may have slight deviations in weight compared to the weights stated in the order or on the website. Such minor differences do not constitute a defect and do not entitle the customer to return the product or request a price reduction.

The warranty conditions of the respective product suppliers, which are included with the products, apply. Mad Beauty Shop GmbH (www.madshop.ch) provides no additional warranties beyond these.

In the event of a warranty claim, the customer is required to contact www.madshop.ch to clarify the warranty handling process.

The decision regarding the type of warranty service lies solely with the supplier. For devices, the possibility of repair is generally considered first.

Warranty services are provided exclusively to the customer and are non-transferable.

Damage resulting from improper handling, normal wear and tear, or external influences for which the seller is not responsible is excluded from the warranty.

14.1

The General Terms and Conditions (GTC) govern the handling of personal data in the context of using the online shop and can be viewed at any time on the website.

15.1

Mad Beauty Shop GmbH (www.madshop.ch) excludes all liability for damages, unless otherwise required by mandatory legal provisions.

15.2

Mad Beauty Shop GmbH assumes no liability for direct or indirect damages, including consequential damages, caused to the customer by a product sold through www.madshop.ch. This particularly applies to damages resulting from improper use, malfunction, or failure.

15.3

Mad Beauty Shop GmbH does not assume liability for theft or loss of items.

16.1

Mad Beauty Shop GmbH (www.madshop.ch) accepts no liability for possible allergic reactions or intolerances and any resulting consequences. It is the customer's responsibility to check the ingredients of the products before purchase and to consider their individual allergies or intolerances.

17.1

Swiss law shall apply exclusively. The sole place of jurisdiction for all disputes arising from or in connection with the contractual relationship is Zurich, Switzerland.
